HitUp Tennis Privacy Policy

1. Introduction & Scope

HitUp Tennis ("we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, store, and secure your information when you use the HitUp Tennis mobile application (the "App") and related services. By installing or using the App you acknowledge that you have read and understood this Policy.

2. Eligibility — 18 Years or Older

The App is intended only for individuals who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not use the App or provide any information to us.

3. Information We Collect

We collect the information necessary to create your account, deliver our services, and improve the App.

All personal data is provided directly by you. We do not scrape social networks or purchase data from third parties.

4. How We Use Your Information

1. Service Delivery — Create and manage your account, schedule matches, display scores, and send confirmations or reminders.
2. Communications — Respond to support requests and send service-related notifications (e.g., verification codes).
3. Personalization — Recommend nearby players or events if you choose to provide location details.
4. Safety & Integrity — Detect fraud, enforce our Terms of Service, and keep competitions fair.
5. Legal Compliance — Meet legal obligations, such as responding to lawful requests from authorities.

We use your data only for the purposes stated above. If we wish to use it for a new purpose, we will obtain your consent or update this Policy.

5. Sharing & Disclosure

We do not sell your personal data.

We share it only:

• With trusted service providers who host our servers or deliver SMS/email on our behalf (bound by confidentiality agreements);
• For legal reasons — to comply with court orders or lawful government requests;
• In business transfers — if we undergo a merger, acquisition, or asset sale (successor will honor this Policy);
• With your consent — for any optional integrations you choose to enable.

Information visible to other users is limited to what is necessary for match coordination (e.g., your display name, match details). We do not reveal your phone or email to other users unless you choose to share it.

6. Data Storage & Security

• Encryption — Data in transit is protected with TLS; sensitive data at rest is encrypted.
• Access Controls — Only authorized staff with a business need can access personal data, under strict confidentiality.
• Security Practices — Regular patches, firewalls, intrusion monitoring, and periodic security reviews.

No internet transmission is perfectly secure, and we cannot guarantee absolute protection. We will notify you promptly if we discover a data breach affecting your information.

7. Data Retention

• Active Accounts — We retain your data while your account is active so that we can provide the service.
• Inactive / Deleted Accounts — Upon your request to delete data or close your account, we erase or anonymize personal data except where we must keep it to comply with law or resolve disputes. Backup copies are purged on a rolling schedule.

8. Your Rights & Choices

Subject to applicable law (including the California Consumer Privacy Act – CCPA):

1. Access — Request a copy of the personal data we hold about you.
2. Correction — Update inaccurate or incomplete information.
3. Deletion — Ask us to delete your personal data.
4. Opt-Out — Unsubscribe from non-essential emails or push notifications.
5. No Discrimination — We will not deny service or charge different prices if you exercise your privacy rights.

To exercise any rights, email us at privacy@hituptennis.com. We may verify your identity before processing your request and will respond within the timeframe required by law (typically 30–45 days).

9. Children's Privacy

We do not knowingly collect information from children under 18. If you believe we have inadvertently collected such information, please contact us so we can delete it promptly.

10. Changes to This Policy

We may update this Policy periodically. If changes are significant, we will notify you via the App or email before they take effect and update the Effective Date above. Your continued use after the effective date constitutes acceptance of the revised Policy.

HitUp Tennis Terms of Service

Welcome to HitUp Tennis! These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and the operator of the HitUp Tennis mobile application and related services ("HitUp Tennis," "we," "us," or "our"). By downloading, installing, or using the app, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the app.

Age Restriction: HitUp Tennis is offered only to individuals 18 years of age or older. By creating an account, you confirm you meet this requirement.

1 | Account Registration and Security

1. Accurate Information — You must provide truthful, current, and complete information when creating an account and keep it updated.
2. Single Account — Each individual may maintain only one account. Accounts are personal and non-transferable.
3. Credentials — You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Suspension / Termination — We may suspend or terminate your account (with or without notice) if we believe you have violated these Terms, the law, or others' rights.

2 | The Services

HitUp Tennis enables adult tennis players in the United States to:

• Create and respond to match invitations ("HitUps");
• Communicate with other players through in-app chat;
• Track and view match scores and statistics;
• Optionally purchase a Season Membership (see § 5) to unlock premium features.

We act solely as a neutral venue connecting players. We neither referee matches nor guarantee that any user will honor commitments.

3 | User Conduct

You agree to use the services only for lawful, respectful, tennis-related purposes. Prohibited behavior includes, but is not limited to:

We may remove content, restrict features, or terminate accounts that violate these rules.

4 | Match Invitations & Chat

• Accuracy — You must provide truthful details (time, location, skill level, etc.) when posting or accepting a HitUp.
• Timeliness — If you cannot attend a scheduled match, notify other participants as early as possible.
• Safety — Meet in public courts and take reasonable precautions. We are not liable for injuries, losses, or disputes arising from in-person play.
• Private Messaging — Chat is intended for match coordination. Do not share sensitive data you would not want others to keep or forward. We generally do not monitor private messages but may review them to investigate abuse or comply with law.

5 | Season Membership (Paid Service)

1. Overview — Season Membership offers premium features (such as advanced matching or higher visibility). Details appear in-app and may change over time.
2. Payment Method — All purchases are processed exclusively through Apple In-App Purchase / Apple Pay; we never store your card data.
3. Auto-Renewal — Unless you cancel at least 24 hours before the current term ends, Apple may automatically bill the next term to your Apple ID.
4. Manage / Cancel — Open Settings › Apple ID › Subscriptions on your iOS device to change or cancel. Deleting the app does not stop renewal.
5. Refunds — Apple handles all refund requests under its App Store policies. We cannot issue refunds directly.
6. Price & Feature Changes — We may modify fees or features for future terms. We will notify you in advance, and you may cancel before the change takes effect.
7. Third-Party SMS or Data Charges — Certain notifications (e.g., verification codes or match reminders) may be delivered by SMS or may consume mobile data. Your wireless carrier may charge messaging or data fees. HitUp Tennis is not responsible for these costs; please check your plan before using such features.

6 | Intellectual Property

All software, trademarks, logos, text, graphics, and other content in the app are the property of HitUp Tennis or its licensors and are protected by U.S. and international laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app solely as permitted by these Terms.

7 | Privacy

Your use of the app is also governed by our separate Privacy Policy, which explains what data we collect and how we use it. By using the app, you consent to that Policy.

8 | Disclaimers

• "As Is" Service — The app is provided as is and as available. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• No Guarantee of Matches — We do not guarantee you will find partners, that matches will occur, or that information provided by users is accurate.
• Third-Party Links — The app may display links or integrations with third-party services. We are not responsible for those services.

9 | Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services is limited to the greater of (a) USD 50 or (b) the amount you paid us (if any) for the Season Membership in the 12 months before the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages.

Some jurisdictions do not allow certain limitations; if those laws apply to you, some or all of the above disclaimers and limitations may not apply.

10 | Indemnification

You agree to defend, indemnify, and hold harmless HitUp Tennis, its affiliates, and their officers, employees, and agents from and against any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the services; (b) your violation of these Terms; or (c) your violation of any third-party rights.

11 | Modifications to Terms

We may update these Terms from time to time. Material changes will be announced in-app or via email before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms. If you disagree with changes, you must stop using the app and, if applicable, cancel your Season Membership.

12 | Governing Law & Dispute Resolution

• Law — These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules.
• Venue — Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
• Time Limit — Any claim must be filed within one (1) year after the cause of action arises, or it is permanently barred.

13 | Severability

If any provision of these Terms is held unenforceable, that provision will be modified to reflect the parties' intention or eliminated to the minimum extent necessary so the remaining provisions remain in full force.

14 | Entire Agreement

These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and HitUp Tennis regarding the services and supersede any prior agreements.
